DWI VIOLATIONS

IF YOU ARE CONVICTED OF DWI

(Driving While Impaired)

Penalties for those age 21 and older who are convicted of DWI:

FIRST CONVICTION:

bullet

Mandatory revocation of your drivers license for a period of one year.

bullet

Minimum Punishment:  Fine up to $200 and not less than 24 hours imprisonment, 24 hours community service, or 30 days without a limited driving privilege or any combination of these. 

bullet

Maximum Punishment:  Fine up to $4,000 and not less than 30 days or more than 24 months imprisonment.

SECOND CONVICTION:

bullet

Mandatory drivers license revocation for a period of four years if convicted within three years of first offense.

bullet

Minimum punishment:  Fine up to $2,000, not less than seven days or more than 12 months imprisonment.

bullet

Maximum imprisonment same as for first conviction.

bullet

No limited driving privilege if second offense occurs within seven year of first conviction.

THIRD CONVICTION:

bullet

Mandatory permanent drivers license revocation when at least one of the prior convictions was within last five years.

bullet

Minimum/maximum punishment same as the maximum punishment for a second conviction.

FOURTH CONVICTION:

bullet

Mandatory permanent drivers license revocation.

bullet

Conviction is considered a felony if three prior DWI convictions within the least seven years.  Minimum punishment is 12 months imprisonment; maximum is 59 months imprisonment and a fine.
